Sirs I am a 57 years old man living in an Old Age Home in Kolkata (a Registered Trust). The monthly fees is Rs. 5,500 and an amount of Rs. 20,000/- paid initially towards Security Deposit (which is Refundable,when a Boarder leaves the old age home ). Presently I am planning to leave this home, hence my question …..if they don't pay/refund my Security Deposit of Rs. 20,000/- then under such circumstance, who is the Competent Authority to Whom I have to write or to make a complaint? Please advise. Regards

Dear Client, As per your query, you should first thoroughly scrutinize the agreement or contract that you may have signed while joining the old age home. The agreement should normally contain the process of refund and authority to approach in case of dispute. If the old age home refuses to refund the amount despite your request, then send a proper legal notice to the old age home. Mention all the important details in the notice itself. This notice will enable to initiate further legal proceedings. If the Old age home refuses to refund your security deposit or does not respond to the Legal Notice within reasonable time then you may approach the Competent Authority. As far as Competent Authority is concerned, you may approach the Charity Commissioner or Registrar of Trusts in West Bengal with your grievance. Hope this answers your query.

Dear Sir, You are not a senior citizen as such you cannot invoke provisions of Senior Citizens Act. However you can recover the same by approaching the police as it is cheating if they did not refund or comfortably file a suit for recovery of said amount with interest.
