to claim third party insuarance claim, do I need to have own damage claim also? I have third party insuarance of 3 years and 1 year own damage claim. my 1 year own damage is expired but 3 years third party is still active. Yesterday I met with accident in which it was clear the other party's fault and he agreed to it also, even in police recods also. Now I want to claim his third party insuarnce for my car, how can I do that? I know I have to file case in MACT but what will be the cost of all the process? Will I get my vehical repaired by insurance company? How much time it will take?
Dear Client, Based on your question and according to on your situation, it seems you will need to file a claim with the third-party insurance with the other driver, as this case is not related to your own vehicle insurance and a totally different case. And to go with this, you will need a copy of the complaint filed at the nearest police station or copy of the FIR is required. And if you are considering using third-party insurance for your vehicle then it is important to keep in mind that it covers only half of the cost of usable spare parts and labour charges, and not only that you will be responsible for the rest remaining amount as well. But it is to be noted that claiming from a third-party insurance of the other party can be a very long process and the process may take months before your vehicle is back in good condition. I hope this advice helps you. For more detail discussion feel free to contact.
I agree with the legal opinion of Mr. Anish Palkar, Advocate.
1) As per your claim it seems that you have to claim with the third party insurance of the other person and his vehicle insurance and so it is not concern with your car insurance for this thing you will require to have the complaint copy of the local police station or the FIR copy.
2) in order to get the third party insurance for your car always remember it is only the 50% of the actual usable spare parts and the labour charges you will have to pay whatever it comes to but in this scenario go if it is a very heavy damage then only I would suggest to go for the third party insurance claim from the opposite party otherwise you can get it done from your local garage which will be less expensive and less time consuming.
3) Also remember that if you are wanting to claim from the third party insurance of others vehicle it will be also a very much time consuming process in which you may have to wait for one month or more for your car to get ready if you can share the details along with the photographs and the video of the actual damage we shall be able to guide you in detail to access the actual damage.
