A, B C, D, E applied for issue of Succession certificate in respect of shares held by X. A passed away after filing the petition, but before issuance of order. E passed away after issuance of order, but before approaching the company for transmission of the shares. B, C & D have now approached the Company for transmission. Company contends that since E is no more, the order has to be amended for them to act upon request of B, C & D. Is this contention correct?
Dear Sir, You may act as per the advise of the concerned Authority or try to convince them since E was alive as on the date of passing of order.
