Dear Client, Regarding your case of the disputed piece of land, the following procedures can be followed, the first one is to seek the services of a property lawyer that deals with such cases. Try to consult the other adjacent property owners, possibly and peacefully settle the problem. In case of failure you can file an application in the civil court for partition to determine rightful boundaries of the parcel based on records. You can also sue for trespass and may also be able to get an order of injunction that prevents further trespass. Some legal frameworks that apply are the Transfer of Property Act, 1882, the Specific Relief Act, 1963, and the Indian Easements Act, 1882. While the filing of demarcation may cost ₹10,000– ₹50,000 or more, depending on the complexity and lawyer fees, injunctions vary from ₹10,000– ₹25,000. Ensure you have collected all necessary documents such as patta and survey records and should act in order not to lose his/her rights. Hope you find this answer beneficial.
