When I first attempted to report the incident, which involved caste-based abuse, kidnapping, assault, theft of my belongings, and non-payment of wages, the police refused to register my complaint. It was only after escalating the matter through the CM Helpline that some action was taken. More than a year has passed since I first raised this complaint. Due to this delay, the Human Rights Commission has declined to hear my case. Recently, the police have managed to recover some of my belongings from the respondent and have informed me that partial payment of my withheld wages is available for collection. However, my belongings are still incomplete, and the respondent is unwilling to pay the full amount owed to me. Furthermore, it is concerning that the police have only filed a complaint regarding the unpaid wages and the return of belongings. There has been no mention of the caste-based slurs, kidnapping, or physical assault in the police record, despite these being severe allegations. When I raised my concerns with the investigating officer, they indicated that my persistence with the case has caused them inconvenience, and they have repeatedly asked me not to pursue the matter further, citing the disturbance it has caused them over the last three days.
Dear client as per your query, You should make a formal written complaint to the Superintendent of Police or other higher authorities, bringing to their notice that there is a grave omission in the police record related to serious accusations in the form of caste-based atrocities, kidnapping, and assault. If they do not respond, you should present an application under Section 156(3) CrPC in the magistrate's court for an order directing the police to register a full FIR covering every accusation. Additionally, you may appeal to the State or National Commission for Scheduled Castes to intervene into the caste-based abuse. In cases where police resistance is persistent, you may file a complaint with the State Human Rights Commission or seek proper legal aid to further pursue this issue.Feel free to book An appointment for a detailed discussion.
Dear Client, since the police have failed to document claims of caste-related abuse and physical assault. You can seek justice under the SC/ST Act, of 1989. If necessary steps are not taken after complaining, to the authorities within the police department like the Superintendent of Police (SP), you may need to address the matter to the magistrate for action. For detailed discussion, you can contact us.
Dear Sir, If police are not registering the FIR in respect of Atrocity offences then approach the higher police officers and/or High Court and get an order.
