Subject: Urgent Legal Advice Needed on Loan Default and Potential Case from IDFC First Bank HI I am seeking urgent legal advice regarding a loan repayment issue with IDFC First Bank in India. Here’s a summary of my situation: Loan Details: I took a loan from IDFC First Bank in February 2022 and moved to the UK in October 2022 for studies. I continued paying installments until July 2023, but due to financial constraints, I could not keep up with payments afterward. Current Status: I recently completed my studies in the UK and have started a small job. While I am actively looking for a full-time position, my current income limits my ability to settle the outstanding loan amount immediately. Request to IDFC First Bank: I have formally requested a 6-month moratorium or a restructuring/rescheduling of the loan. However, I have not received any response from the bank regarding these options. Bank’s Actions: The bank has been contacting me, demanding immediate payment. They have now warned that they will file a case against me if I do not clear the dues or arrange for a settlement soon. I had given a post-dated cheque to the bank as a security, which they may present if I am unable to resolve the payment issue. Concerns about Police Clearance: I have a job offer that requires a Police Clearance Certificate (PCC), and I am concerned about how this situation may affect my clearance. I understand that if the bank files a case, especially under Section 138 of the Negotiable Instruments Act (cheque bouncing), it could appear on my PCC, potentially impacting my current employment and future job prospects. Could you please advise on: The immediate legal implications if IDFC First Bank files a case under Section 138 for cheque bouncing or any other legal grounds? Options for resolution: Is there a way to negotiate or defer the repayment to avoid a criminal case? Are there any steps I can take to protect my PCC status? Possible outcomes on my clearance: How likely is it that this issue will impact my PCC in the UK, and are there preventive legal actions I can take to address this? Thank you very much for your guidance. I am willing to explore all reasonable options to resolve this matter and avoid any criminal record.

Dear Client, If IDFC First Bank initiates legal proceedings under Section 138 of the Negotiable Instruments Act for cheque bouncing, it may lead to criminal charges with potential penalties, including fines or imprisonment for up to two years. To prevent escalation, timely action is essential. Since you have already requested a moratorium or loan restructuring, the bank’s lack of response could be viewed as uncooperative, possibly aiding your case. Options for Resolution: Negotiate with the Bank – Continue pressing for a loan restructuring or moratorium. Document all communication attempts, and if needed, escalate to senior officials within the bank or consider mediation. And, Alternative Payment Arrangements – Suggest a payment plan that aligns with your current financial situation, even if it means smaller installments until your finances stabilize. Protecting Your Police Clearance Certificate (PCC): A Section 138 case could impact your PCC, critical for employment. Prioritize resolving the loan to avoid potential legal issues. A lawyer can assist in protecting your interests and filing a counter-complaint if the bank proceeds without considering restructuring. Potential Outcomes: Successful negotiation may prevent negative impacts on your PCC. However, if unresolved, legal action could result in a criminal record affecting job prospects domestically and internationally. Given the urgency of your situation, I recommend taking immediate action by contacting IDFC First Bank again, documenting all interactions. Feel free to book an appointment for a detailed discussion.
