नमस्ते! पीड़ित महिला का दहेज और भरण-पोषण का केस 2022 से निचली अदालत में चल रहा है। कुछ दिन पहले महिला अपने दोनों बच्चों के साथ पति के घर गई, लेकिन ससुराल वालों ने उसके साथ मारपीट और गाली-गलौज की और पति ने गुस्से में तीन बार तलाक बोलकर उसे घर से निकाल दिया। महिला ने 112 पर कॉल करके पुलिस को बुलाया, लेकिन पुलिस वापस चली गई। महिला थाने गई, तो पुलिस ने एफआईआर दर्ज करने से मना कर दिया और कहा कि तुम्हारा पहले से केस चल रहा है, इसलिए एफआईआर नहीं होगी। मेरे प्रश्न: 1. क्या इस परिस्थिति में ट्रिपल तलाक की एफआईआर दर्ज नहीं होगी? 2. क्या पुलिस एफआईआर दर्ज न करने का जो कारण बता रही है, वह सही है? 3. क्या महिला को पति के घर में रहने का अधिकार नहीं है?

Dear Client, in this circumstance, an FIR can be filed regarding the husband's pronouncement of triple talaq. The practice of triple talaq (talaq-e-biddat) has been declared illegal and unconstitutional by the Supreme Court of India in 2017, and it is punishable under the Muslim Women (Protection of Rights on Marriage) Act, 2019. Therefore, the woman has the right to file a complaint against her husband for this act. Further, the police's reasoning for not registering an FIR based on the ongoing case is not valid. The existence of a prior case does not preclude the filing of a new complaint regarding different offenses, especially one involving domestic violence and illegal divorce practices. The police are obligated to register an FIR when a cognizable offense is reported. Regarding her right to reside in her husband's home, as a legally married woman, she has the right to live there until a valid divorce is executed according to law. Dear Client, based on your queries, 1. FIR can be lodge for Tripple Talak , as it is criminal offence under the Muslim Women(Protection on Rights of Marriage)Act 2019. so you can file under this Act and it is Cognizable Offence. 2. your matter is different from the matter what is going on in the court. so the reason which Police officer stated it is incorrect. you can go SP of the Police station and lodge FIR. 3. Woman has right to live in her in laws house. Husband cannot forcefully evict her wife without any legal order from the court for example either judicial separation or Divorce. If your husband forcefully evict from his house you can lodge FIR or file a criminal case for Cruelty against women under section 498A of IPC(new BNS Section 84). Hope this answer help.
