Sir, I am Surapureddy Kumar Rao, aged 63 years, purchased a Plot No. 38 in Survey No. 124/48 of Rangareddy District, Serilingampally Mandal, Gopannapalli Village and Gram Panchayat, measuring 300 sq. yards in the year 1990 and the said plot registered in my name vide Registered Sale Deed No. 9439/1990 dated 25th July 1990. Till today the above registered plot is in my name in the register of the Govt. of Telangana Registration and Stamp Department. Since I served in Armed Force of the Union and I liable to serve anywhere in India on Govt. Interest, I had left Hyderabad in the year 2003 and when I reached in 2011 after serving different states it was learnt that in Nov, 2006 my land was acquired by the than Govt. Of Andhra Pradesh. Since then, I made several correspondence to the concerned authorities and knocked every door of the Revenue authorities but all in vain. Finally I had approached to Prajavani at Hyderabad and submitted my grievances application to the CM of Telangana Govt. on 29-12-2023 in Praja Bhavan vide Ref ID No.12292023084817. In response to my grievances the intimated vide their letter No. Memo No.B/913/2024 dated 19-07-2024 that “Through the reference 1st cited, the applicant has filed an application at Prajavani. In this regard the application has been examined by Additional Mandal Girdawar and submitted report stating that, the mentioned Subject is a Private Dispute and the applicants may approach civil court. Hence the same is informed” . Kindly advise, As per their direction, if I approached to the Civil Court, 1. Who should be named as respondents? Because I don't know whose position that plot is in, if the plot is not acquired by the Govt. and Plot location is also not known correctly. 2. How to know the correct location of the plot. 3. Will there be any benefit if we approach the civil court? 4. How much will the court fees be?

Dear Client, As per your query, you should file a civil suit in which you may name the State Government authorities such as District Collector or Land Acquisition Officer as respondents and note "Unknown Occupants/Encroachers" in case the existing possessor is unknown. Find updated details of survey and land records and apply for clarification through RTI about any acquisition with Telangana Survey and Land Records Department. You can come to civil court and achieve a decree of title declaration, repossession, and a permanent injunction under the Specific Relief Act, 1963. The court shall also make an order as to payment of mesne profits on proof of unauthorized possession. Charges in court tend to work out at some 5%-7% of property value and thus can often be estimated, using official valuation from Sub-Registrar's office,. Dear Sir, You have neglected your rights over the property. Just take the possession and if any bod obstructs they lodge a complaint with police thus you can know about their rights over property. Thus you can proceed.
