Claim settlement and Rejections
22-10-2024

I’m facing a lot problems in my life and the reason is I was in a relationship with my boyfriend for [one year of relationship]. During the course of our relationship, he repeatedly promised to marry me. These promises were made both in personal conversations and through messages on chats and calls, which I have saved as evidence. And we were in a physical relationship. During this time, However, after some time, he changed his mind and is now refusing to marry me, despite the commitments he made and the fact that I was serious about him . I feel misled and emotionally harmed by his actions, as he made serious promises that influenced important decisions in my life. I would like to know how I can seek legal action for this breach of promise and for the emotional and mental distress this has caused me.

Dear Madam, Without any further delay approach higher police officers and request them to either celebrate your marriage with him or register a case of cheating and put him behind the bars.

Dear Client, As per your query, where a false promise to marry to you was given by your partner, criminal and civil law can both be availed. There's recourse under Section 318 of BNS, 2023, for it can then be established that the other party did not intend to marry you and has thus cheated you of your emotions. In addition, if the physical relationship was also premised on this false promise, it may amount to rape BNS, 2023, as consent given under deception is invalid, and you can file an FIR under the provisions of BNS, 2023. Similarly, for emotional distress and breach of promise, you may file a civil suit for compensatory damages. The evidence will include some saved messages, which are going to be very important in that case. Feel free to book an appointment for a detailed discussion on the issue.
