Workplace Safety for Women: Supreme Court’s New Rules for POSH Act Directives

INTRODUCTION

In a landmark judgement to strengthen workplace safety for women the Supreme Court of India has issued new directive, which mandates strict implementation of Sexual Harassment of Women at Workplace (Prevention Prohibition and Redressal) of 2013, which is POSH Act.

The order emphasizes on accountability and robust mechanism to handle complaints of sexual harassment in workplaces across the country. The judgement came in response to growing concerns about non-compliance with the act. Even after a decade after its enactment, the court highlighted some reports, which clearly suggested that many organizations specially in the unorganized sector had either failed to constitute ICC or they have lacked awareness about the posh framework.

BACKGROUND

The Supreme Court's directions stem from a public interest litigation, highlighting widespread norm plans with the POSH Act 2013. The case revealed that many organizations, especially in an unorganized sector failed to form Internal Complaints Committee that is, ICC or conduct awareness programs leaving victims without proper redressal mechanism. The petition called attention to the lack of oversight and implementation of the law, prompting the court to intervene and issue stricter guidelines to ensure workplace safety from women.

KEY POINTS

  • Mandatory ICC formation: All organizations with 10 or more employees must constitute an ICC within a stipulated time frame. Strict penalties will be applied for the non-complaints of the same

  • Annual complaints report: Employees must submit annual complaints reports, which has the detailed POSH implementation status to district authorities

  • State level monitoring Committees: Each state must establish a monitoring committee to oversee the complaints across public and private sectors

  • Awareness campaigns: The Central and state governments are directed to launch nationwide campaigns to educate employees, employees and gender public about the act provision.


RECENT DEVELOPMENTS

The bench observed the importance of the act in fostering gender equality and workplace dignity, it said that the workplace must be a safe space for women to contribute freely and confidently.

The Central government is expected to issue detailed guidelines to implement the directives efficiently. Industry leaders, Employee unions and non-governmental organizations are gearing up to elaborate the new mandatory guidelines. Intervention by the supreme court has been taken to have a safe workplace and it does not only become a legal obligation but becomes a moral imperative.

CONCLUSION

The Supreme Court's recent guidelines are an affirmative step toward the effective enforcement of the act that would reinforce safe and equitable workplaces for a woman by mandating strict complaints and highlighting the accountability. The very strong message was sent out by the court stating that the gender inequality will not be tolerated. These guidelines, in addition to upholding a woman's constitutional right to dignity, will also pave the way by fostering enclosure and respectful work environments across all sectors.
