BACKGROUND
The concept of separation of powers is a central component of the governance, which ensures that all three branches of the Government are functioning independently maintaining a balance.
The concept of separation of powers plays a vital role in the matter of public contract disputes. Public Contracts are closely related and have a direct effect on the Government proceedings.
In recent times where the cases related to public contract disputes have been growing enormously, the Supreme Court in its recent judgement has made a remarkable decision clearly stating and emphasizing the separation of powers in public contract disputes stressing the importance of transparency and judicial oversight in government contracting processes.

REINFORCING SEPARATION OF POWERS
The Supreme Court has always emphasized that though the executive branch of the Government forms the decisions through its authority about contracts, these decisions must follow legal principles and cannot be arbitrary. The judiciary body plays a vital role in reviewing such decisions to make sure that they are fair.
TRANSPARENCY IN PUBLIC CONTRACTS
Transparency is one of the main concepts in these cases. Naturally, government contracts are expected to follow fair legal proceedings that treat everyone equally. In case of irregularity, the public loses its trust in the Law and Government.
The SC in its recent ruling has also stressed the same matter of transparency.
SUPREME COURT’S RULING
In a landmark judgement, the Supreme Court of India stressed the importance of transparency and judicial oversight in the government contracting process. In the case of Subodh Kumar Singh Rathour v. The Chief Executive Officer & Ors., dated July 9, 2024, the court made it clear that the government cannot arbitrarily cancel public tenders without any solid reasons. The Court’s decision upheld the fact that fairness and transparency must be maintained in all contracts involving the State.
CONCLUSION
The remark by the Supreme Court on maintaining the separation of powers and ensuring judicial oversight in matters of public contract dispute is significant for protecting and upholding transparency and fairness in contracts of the Government.
