SUICIDE NOTE SPARKS LEGAL STORM IN ATUL SUBHASH CASE

INTRODUCTION

On December 16, 2023, the Allahabad High Court heard a transit anticipatory bail plea arising out of a case filed against Sushil Singhania, uncle of the estranged wife of Bangalore techie Atul Subhash, for abetment to suicide. He has been accused along with his family members in a suicide note and video left behind by the deceased. The accused cast serious doubts on the authenticity of the suicide note and questioned the hurry with which the police arrested the accused person.


BACKGROUND

The case pertains to the alleged suicide of 34-year-old techie Atul Subhash, who left behind a 24-page suicide note, an 81-minute video recording, and a placard displayed in front of his corpse, inscribed with the words “Justice is Due.” Subhash accused his wife, Nikita Singhania, of having harassed him and pressed for the divorce, alimony, and child custody case in Jaunpur, Uttar Pradesh.

Atul's brother Bikas Kumar on August 1 lodged an FIR in Bengaluru against Nikita and her family members under Section 306 IPC for abetment of suicide, following the death of Subhash. Subsequently, Nikita, her mother, Nisha Singhania, and her brother, Anurag Singhania, were arrested, and Sushil Singhania all the meanwhile remained the sole applicant seeking anticipatory bail.

  1. Veracity of the Suicide Note: Manish Tiwari, senior advocate for Sushil Singhania, raised serious doubts about the authenticity of the suicide note. Tiwari said, “If this suicide note is to be believed, only God knows when everyone would be in the dock.” He stated that the family court judge was also mentioned in the note, yet no inquiry was initiated against him, creating a halo of selective attack.

  2. Hurdle in Police Work: He harshly criticized this hurry of the police in arresting the accused, terming it as unprecedented. "Osama bin Laden's problem wasn't resolved with such quickness," he pointed out. "In the FIR there was a reference of this matter on December 9, a plea submitted on December 12, and the arrests taken place on December 13-14." He said that the Prayagraj police were not even informed before the arrests and called this violation of the norms of procedure.

  3. Explanations of the Government and Accusations: The Government Advocate refuted this sweet charge by saying that the persons were arrested from Jaunpur, and that, too, after duly informing the Superintendent of Police. The complainant's counsel, in reply, remarked that the suicide video has accusations made against Sushil Singhania, alleging that he had harassed the deceased for money.

  4. Custody of Minor Child: Counsel for the complainant, on the other hand, alleged that there have been concerns regarding the custody of the minor child of Atul and Nikita, with allegations that this minor child was under Sushil Singhania's care. Tiwari, refuting that point, argued that Sushil was a patient suffering from neurologic disease and could hardly move about with a child; he called the allegation frivolous.

  5. Concession of Limited Relief: Tiwari clarified that he was not arguing the merits of the case and limited his plea only to the grant of anticipatory bail pending transit up to January 2, 2024, so Sushil Singhania might approach the competent court in Karnataka after winter vacation. 


RECENT DEVELOPMENTS

The Allahabad High Court has listened to long arguments on both levels on the plea seeking transit anticipatory bail, which will be reserved for orders in the next few days. The order of this Court shall finally decide whether Sushil Singhania gets temporary protection to approach the Karnataka courts where the case is mainly registered.

 

It is notable that whereas Nikita Singhania, along with her mother Nisha and brother Anurag, was arrested earlier, their petitions for anticipatory bail were rendered infructuous with their arrests. Therefore, Sushil Singhania is the only person who is giving the golden opportunity at this stage.

 

The series of developments in this case have brought a heavy scrutiny onto issues of procedural fairness and the role of suicide notes in the criminal process. The ruling, when it comes, is expected to provide guidance on what steps can be initiated against the accused and may also set a precedent within this type of ambit with an abetment to suicide angle.


CONCLUSION

This matter raises pertinent questions concerning not only the investigation of abetment but also about procedural fairness in police actions and the evidentiary value of suicide notes. With the order reserved on the plea of Sushil Singhania, the next hearing would be crucial in determining the now-on-the-line direction of the case, thereby affecting the course of this anticipated dogfight.
