Punjab's Press Freedom on Trial: Court to make decision on Journalist Taggar's Bail and Government Accountability

Punjab and Haryana High Court has recently accessed Punjab government’s actions in apprehending journalist Rajinder Singh Taggar in a defamation and extortion case he wrote a news story. In his story he claimed that there were particular real estate companies who were unlawfully taking over government-owned lands in Mohali.
Justice Sandeep Moudgil, who was presiding over the case, expressed worry regarding the arrest since he argued it could not only be an abuse of justice but also touch on press freedom. It was observed by the court that Taggar had been languishing in detention for already over a month having solely published a news piece against the complainant and his business entities. This put into question both individual rights and the principles of democracy which guide any administration.
Rajinder Singh Taggar, a journalist from Punjab, filed a bail application, hoping to be released. He was granted interim bail on July 1, and the Punjab government was called upon to explain their actions against him. The court noted that such actions by a government could amount to breaching one’s fundamental rights under article 19(1)(a) of the Indian constitution especially regarding freedom of speech and expression and ordered to provide an online response.
Prior to this case, Taggar’s online news channel called “Punjab Dastavez” had released a story that accused the NK Sharma Enterprises Pvt Ltd together with Savitri Green-2 Projects of having illegally occupied government land within Mohali. The report claimed that the politician also known as builder was being assisted by some officials working within the state revenue department in his capacity either as public representative and/or entrepreneur.
NK Sharma Enterprises filed a defamation suit against Taggar in response to which he was arrested on allegations of defaming their projects and trying to extract money from their platform. Taggar’s legal representation argued at a bail hearing that the journalist’s criminal case was a result of highhandedness, nepotism, and compromise among powerful individuals like NK Sharma plus senior bureaucrats.
Taggar was granted interim bail by the court and future proceedings were slated for 29th July; on that day in question, the Punjab government will be needed to further explain itself. The client was represented by RS Bains and Aarushi Garg, while the State of Punjab was represented by JS Rattu during the proceeding.

NK Sharma Enterprises responded by filing a complaint against Taggar, accusing him of defaming their projects and attempting to extort money through his platform. This led to Taggar's arrest.
 On July 1, bail was imposed on Taggar by the court. The government of Punjab was to answer for the treatment it meted out on the journalist.
