LEGAL ACTION OVER VISHALGAD FORT: THE BOMBAY HIGH COURT TO DETERMINE ON PRESERVATION VS. DEMOLITION

BACKGROUND -

A cultural and historical site of great importance is the Vishalgad Fort, a monument located in Kolhapur district, Maharashtra. The fort constructed by King Chhatrapati Shivaji Maharaj in the 17th century symbolizes Maratha's bravery and heritage. Throughout these years, it has been visited by many tourists, historians, and scholars. However, this has led to legal battles that have emerged as a result of the demolition of existing structures inside the fort area.


INTRODUCTION -

The ongoing battle between citizens and heritage conservationists has landed them at the Bombay High Court, calling for intervention to stop the demolition of structures at Vishalgad Fort in Maharashtra state. Affording care for it may be ripped apart with an argument that has gained momentum from the fact that local authorities have planned to raze down buildings. They therefore insist on conservation work as a careful process while considering appropriate proportionality between development objectives and protection mandates.

The petitions that directed the court to stop the demolition activities until an all-inclusive heritage evaluation was done were supposed to be heard in the Bombay High Court on July 19th, 2024. According to them, haste in dismantling would undermine the continued research and cultural legacy of the fort. They further plead for making clear distinctions between illegitimate constructions and those with historical significance, thereby guaranteeing that any intervention made is informed and maintains the sanctity of the site.
