Bombay High Court Expresses Dissatisfaction Over Handling of Badlapur Sexual Assault Case

BACKGROUND
A suo motu cognizance was taken by the Bombay High Court following the sexual assault of two minor girls that happened within the school premises on 22, August 2024. It came after it sparked an extensive public outrage. A janitor aged 23, was arrested in relation to the case and the Bench questioned the integrity of the investigating officers as there was delay in lodging the FIR. The Judges were shocked as the was no legal action taken against the school under Protection Of Children From Sexual Offences (POCSO) ACT and also the parents were made to wait for eleven hours to file the case.
KEY ASPECTS
LAPSE OF THE POLICE
After the incident came into light there was unnecessary delay from the part of the police to lodge an FIR against the school, as well as the parents were made to wait for eleven hours to give their complaint. The court held that such delays on the part of the police are unacceptable as it undermines the authority of the legal arena especially in cases that involves minors. There was failure on the part of the police to record the statements of the victims and their guardians, which reflects poorly on the commitment of the police force to ensure the safety of the general public.
ENCOUNTER OF AKSHAY SHINDE
An accused named Akshay Shinde who was a janitor in the school was taken into custody, but killed in an encounter. It raised serious questions about why the police officers could not overpower him. The court also expressed concerns over it, that the investigation should be conducted in a fair and just manner and that it cannot be called as an encounter.
Respondent State’s Defense:
Advocate General Dr. Birendra Saraf, representing the State of Maharashtra, assured the bench that an FIR had been lodged and a Special Investigation Team (SIT) had been formed to handle the case in respect to the concerns of the Bench. He ensured that the investigation would be pursued dynamically and that all necessary actions would be taken to ensure justice for the victims.
He assured the court that no stone would be left unturned and that the investigation would be conducted immediately. The State’s defense focused on rectifying the procedural errors and addressing the lapses noted by the court.
IMMEDIATE ACTION AND SAFETY
The court’s judgment included a call for immediate action from the State to address the procedural lapses and ensure that all necessary measures were taken to support the victims. The court’s order emphasized that the victims’ welfare should be prioritized and that the State must take all necessary steps to ensure their safety and well-being. The actions of the police reflected a serious lapse in the investigation process. The Court was also outraged that the incident occurred within the school premises which should have been a safe environment for the children. The court also held that the school holds a larger accountability in preventing such incidents.
CONCLUSION
In the order of Bombay High Court, it has recorded its dissatisfaction with the delay in registering the FIR and the lack of action taken against the school authorities. The court’s decision emphasised the need for imperative reforms in the management of sexual assault cases, predominantly those involving minors, and the importance of police sensitization and to comply with procedure. The judgment highlights the need for an effective response to such serious allegations and the need to provide appropriate support for the victims. It is the intervention of the court that again reminds us of the important role played by the judiciary to ensure justice is being served to all and that the victims are safeguarded. The judgement also places a responsibility on the police force and the schools to handle such cases responsibly and to prevent incidents of abuse where they must be protected. The bench stressed the importance of providing counseling and legal assistance to the victims and their families.
